The accuser claimed that her husband, who is our client, had grabbed and pinched her forearms and punched her in the shoulder. She showed the police officer a small bruise on her left forearm and on her right shoulder. She claimed that our client slapped her on the left side of her face and neck. He then grabbed her under the throat and threw her on the bed.
Our client told the police that he wanted to speak with the accuser so he grabbed her by the forearms and tried to sit her down to talk.
The police officer believed the accuser over our client, and charged our client with Domestic Battery.

The City of Naperville Legal Department has its own prosecution office that prosecutes DUI cases as well as traffic and ordinance violation matters. The city prosecutors do not, however, prosecute Naperville domestic violence cases. Naperville domestic violence cases are state charges which are prosecuted by the State’s Attorney’s Office.
Naperville Domestic Violence cases will be heard in Courtroom 4007 of the DuPage Courthouse located at 505 N. County Farm Rd., Wheaton, IL, 60187. Courtroom 4007. If an incident occurs in parts of Naperville that are in Kane or Will County, then the case will be heard in those courthouses.
Upon arrest, a suspect is taken to the Naperville Police Station. From there, he or she is transported to the DuPage County Jail. He or she is than taken to the DuPage Domestic Violence judge who sits in DuPage Courtroom 4007. The judge sets a cash bond amount and sets conditions of bond that usually include a period of no contact with the victim and an order to relinquish a FOID card and firearms. The suspect is then released with notice of a future court date in Courtroom 4007.
